Minor side swipe by semi truck. Our client was side swiped by a semi-truck on the I-5 Freeway. The impact was not severe, and there was only $1,000 of property damage. Our client was driving on the 138 when a big semi-truck made a left right in front of him, causing a terrible car accident. P.S. Acton, CA$5,000,000 Settlement
Our client, a 43 year old postal worker and mother of 4, was involved in a 3-car accident on the 14 Freeway in Acton when a vehicle hit her, forcing her into a construction zone, where her vehicle hit the exposed blunt end of the center median, which was undergoing repair. The insurance companies for the other two drivers quickly paid the limits of their policies, but that did not begin to fairly compensate our client for the severe injuries she suffered, which included a below the knee traumatic amputation of her right leg. Kuzyk Law began investigating the condition of the construction zone, and ultimately filed a lawsuit against Caltrans and the general contractor who was performing the repairs. We discovered that the contractor had left the center median unguarded, against the advice of Caltrans’ safety engineer, in order to save the cost of erecting temporary barriers. Armed with this information, we were able to negotiate a $5 million settlement with the general contractor’s insurance company.
P.L. Victorville, CA$1,200,000 Settlement
Our client, a 36 year old mother of 3, was involved in a “t-bone” car accident at a 4-way stop sign intersection off the 15 freeway in Victorville when the other driver ran his stop sign and crashed into our client’s driver side door. Our client suffered broken bones and internal injuries, and the other driver’s insurance company offered to settle the case for a low amount. Kuzyk Law’s evaluation of the case, however, was that P.L had suffered a traumatic brain injury (“TBI”) which warranted at least a $1 million settlement. We hired specialists in evaluating TBI cases, including a radiologist who administered a special type of MRI designed to detect changes in the brain as a result of trauma, but the defendant’s insurance company still refused to budge. The case went to trial, and after six weeks of testimony, including from our experts, the other driver’s insurance company paid $1,200,000 to settle the case.
D.S. Angeles Forest, CA$1,000,000 Settlement
$1,000,000 Settlement; slip and fall premises liability. D.S., a 60 year old bus driver, volunteered as an instructor at a summer camp for inner-city kids in the Angeles Forest. While walking to the dining hall he stepped on a soft patch of dirt in a camp road which had recently been repaired, and fell, breaking his left leg. The fracture was severe, requiring the insertion of a rod and multiple other surgeries, and D.S. suffered a permanent limp. The camp and the contractor who’d performed the road repairs denied responsibility for D.S.’s injuries, claiming it was all his fault. Kuzyk Law took the case, and after filing a lawsuit, discovered that the hole D.S. had stepped in was an uncovered vault containing a valve for a recently installed fire hydrant, and that the cover was being used as a doorstop in a nearby building.
